General Terms and Conditions — Property Listings
Version of October 15, 2026
In case of doubt, the German version prevails.
§ 1 Definitions and Parties
Platform
Terra Mia Immobiliare, owner Oskar Golde, Regattastraße 9h, 16816 Neuruppin, Germany. VAT ID: DE302445319. Operator of the portal network at terra-mia.immo and all associated property domains.
Advertiser
A natural or legal person who lists one or more properties for sale via the portal network. If the Advertiser is not the owner, the Advertiser warrants that the owner has authorized the listing and sale.
Listing
The presentation of a property (description, photos, data, price) placed by the Advertiser on the portal network.
Prospect
A prospective buyer who submits an inquiry regarding a listing. The relationship between the Platform and the Prospect is governed by a separate document (Inquiry Terms).
Conclusion of Contract
The contract between the Platform and the Advertiser is concluded upon creating a property listing and accepting these terms.
§ 2 Scope of Services and Limitations
Listing Platform
Terra Mia Immobiliare provides a platform on which the Advertiser lists properties for sale and promotes those listings across its own portal network and via SEO, AEO, social media and, where applicable, partner channels.
No Brokerage, No Commission
Terra Mia Immobiliare is not a real-estate broker and does not act as one. It does not broker the purchase contract and charges no sale or buyer commission. The Platform's service is limited to the paid provision and promotion of the listing.
No Purchase Contract via the Platform
Any purchase contract is concluded solely and directly between the Advertiser (or owner) and the Prospect. Terra Mia Immobiliare is at no time a party to the purchase relationship.
No Advice, No Valuation
Terra Mia Immobiliare provides no legal, tax or financing advice and no market or fair-value appraisal. Any editorial market reports are non-binding information, not a valuation service.
No Duty to Verify
Terra Mia Immobiliare is not obliged to verify the existence, ownership, condition, legal admissibility or accuracy of the details of a listed property. The Advertiser alone is responsible for all details.
§ 3 Registration and the Advertiser's Obligations
Truthful Information
The Advertiser must provide truthful, complete and up-to-date information at registration and throughout the term. Changes (availability, price, contact details, etc.) must be entered without delay; sold or withdrawn properties must be marked or deactivated immediately.
Authorization
The Advertiser confirms that they have full legal capacity, are the owner or duly authorized by the owner, and are entitled to list the property. Third-party rights must not be infringed.
Lawfulness of Content
The Advertiser only submits content (text, photos, plans) for which they hold the necessary rights and ensures that the listing and its promotion do not breach applicable law (competition, copyright, data-protection law, etc.).
§ 4 Mandatory Listing Details
Statutory Details
The Advertiser must include in the listing all details required by the law of the place where the property is located. For properties located in Italy this includes, in particular, the details of the energy performance certificate (Attestato di Prestazione Energetica, APE): energy class, energy value and heating type, unless exceptionally exempt. Where the certificate has been commissioned but not yet issued, or where the property is exceptionally exempt, the Advertiser may state this in the listing accordingly; the obligation to complete the details remains.
Responsibility
The accuracy and completeness of these mandatory details are the sole responsibility of the Advertiser. Terra Mia Immobiliare reproduces the details unchanged and owes no substantive review (Section 2.5).
Price
The Advertiser states the purchase price. A "price on request" notice is permitted where legally allowed.
§ 5 Listing Fees and Payment
Paid Service
Placing a listing is subject to a fee. The fee schedule in force at the time of booking applies, published on the respective pricing page. All prices are final prices. VAT is shown in accordance with the VAT rules in force at the time. Where an Advertiser in another EU member state supplies a VAT ID confirmed at the time of booking, liability for the tax passes to the recipient of the service (reverse charge under Article 196 of Directive 2006/112/EC); where the Advertiser is based outside the EU, no German VAT is charged. In both cases the amount payable stays the same. No sale commission is charged. If the Advertiser is a consumer (§ 13 BGB), the "Right of withdrawal" annex additionally applies.
Fee Types
One-off listings (fixed term) and annual plans (unlimited listings within the term) are offered per the fee schedule. The plan chosen, its price and its term are shown to the Advertiser before conclusion.
Invoicing and Payment
Terra Mia Immobiliare invoices the chosen fee; payment is made via the payment providers offered on the platform. The listing is activated after payment is received.
No Success Dependency
The listing fee is owed regardless of whether a sale or any inquiries result. There is no entitlement to any particular marketing outcome.
§ 6 Listing Term and Termination
One-Off Listing
A one-off listing runs for the duration stated in the fee schedule — for a sale listing, 180 days from activation — and then ends automatically; renewal must be booked and paid for anew.
Annual Plan and Renewal
An annual plan runs for one year from activation. It does not renew automatically (§ 309 No. 9 BGB); continued use requires a newly and expressly booked plan. The Advertiser may cancel a running subscription at any time via the cancellation button in the account (§ 312k BGB); cancellation takes effect immediately, access remains until the end of the paid term. No pro-rata refund of the annual price is given.
Early Removal
The Advertiser may deactivate a listing at any time. No refund is given for the remaining term of fees already paid, unless the removal is due to a circumstance for which Terra Mia Immobiliare is responsible.
Removal by the Platform
Terra Mia Immobiliare may edit listings for language and form (spelling, formatting, translation) and may suspend or remove listings that breach these terms or applicable law, contain incorrect mandatory details or infringe third-party rights. Changes to the content are made only with the Advertiser's consent. For minor breaches, Terra Mia Immobiliare first sets a reasonable deadline to remedy them. In cases of serious or repeated breach, the account may be suspended. Terra Mia Immobiliare informs the Advertiser of the facts and reasons in text form no later than when it takes the measure; the Advertiser may respond. Once the reason no longer applies, the measure is lifted without undue delay.
Payment Default
If a due payment fails, Terra Mia Immobiliare grants a 14-day grace period during which listings remain visible. After the period lapses without payment, all of the Advertiser's active listings are set to inactive; the listing data is retained for reactivation upon renewed payment.
Order of Listings
Until October 31, 2026, in the default sort order ("Recommended"), Terra Mia Immobiliare first shows listings it has placed first by hand in individual cases because their details and photos are especially complete, informative and up to date; then all others, newest first, so that prospective buyers see current offers. From November 1, 2026, the order under Section 6.8 applies. A fee or a particular plan has no influence on the order. Visitors can instead sort the listings by price or living space.
Data
Terra Mia Immobiliare stores the information that Advertisers and prospective buyers provide with listings and inquiries, as well as usage data of the listings, and uses it to operate the portal network, for the order of listings (Section 6.6) and to improve the portal network. In their account, the Advertiser sees the inquiries about their listings, but not the data of other Advertisers. When the contract ends, the data is deleted unless a statutory retention obligation applies. Terra Mia Immobiliare passes this data on only where this is necessary for operating the portal network (for example inquiries to the Advertiser, data to service providers for email delivery and hosting) or where the law requires it. The Advertiser receives their data on request until the contract ends. Details are set out in the privacy policy at terra-mia.immo/privacy-policy.
Order of Listings from November 1, 2026
From November 1, 2026, a score determines the default sort order ("Recommended"). Each portal (for Sicily, Sardinia and Calabria) is scored separately; a listing is compared only with the active listings of its own portal. The score has four components: inquiries about the listing (40%), visits through the listing's share links in which the visitor does not leave right away (25%), completeness of the listing (20%) and other views of the listing page (15%). Inquiries show most clearly whether a listing appeals to prospective buyers, so they count the most and plain views count the least. Bookings and reviews are not included. For each component, what counts is how the listing performs compared with all active listings on the same portal (percentile rank); a listing with no values in a component scores zero there. The last 90 days are counted, with older events losing weight (half-life 30 days). Per day, at most 15 visits through share links and 30 views count. The same person counts as an inquiry at most once per listing in 30 days; inquiries from the Advertiser's own account or email address never count. Completeness means five items worth one fifth each: at least 12 photos; a description of at least 200 characters in German, English and Italian; the sale price; the energy class, or a statement that none is required or that an exemption applies; and the living space (for plots, the plot area). New listings appear at the top for their first 14 days (no more than three at a time, the newest first); this lead phases out by day 30, and until day 60 the listing receives at least the median value of all listings on the portal in each component. A listing does not get this start again if the same Advertiser had a listing within 50 meters on the same portal in the previous 12 months. Listings that Terra Mia Immobiliare has placed first by hand in individual cases, because their details and photos are especially complete, informative and up to date, come before all others; then the score applies, with the newer listing first on an equal score. A fee or a particular plan has no influence on the order. Manipulation is prohibited, in particular automated views, inquiries about one's own listing and purchased visits; in such cases, Terra Mia Immobiliare may exclude individual inquiries or visits from the scoring. Visitors can instead sort the listings by price (ascending or descending) or by living space; there, the score only decides ties.
§ 7 Rights to Content and Indemnification
Usage Rights
The Advertiser grants Terra Mia Immobiliare the non-exclusive right, limited to the duration of the listing, to use, translate and technically adapt the provided content (text, photos, plans) for the purpose of displaying and promoting the listing across the portal network and associated advertising channels.
Indemnification
The Advertiser indemnifies Terra Mia Immobiliare against all third-party claims arising from unlawful, incorrect or infringing content in their listing, to the extent the Advertiser is responsible for it and the content was not changed by Terra Mia Immobiliare, including reasonable costs of legal defense.
§ 8 Liability
Third-Party Content
Listings reproduce only the Advertiser's details. Terra Mia Immobiliare does not adopt them as its own and is not liable for their accuracy, completeness, currency or legal admissibility, nor for the conclusion or content of a purchase contract.
Limited Liability
Terra Mia Immobiliare's liability is excluded except in cases of intent or gross negligence, injury to life, body or health, and breach of essential contractual duties. Essential contractual duties are duties whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the Advertiser may regularly rely. For simple negligence, liability is limited to the foreseeable damage typical of the contract. Liability under the German Product Liability Act, for fraudulently concealed defects and for guarantees given remains unaffected.
Availability
Terra Mia Immobiliare does not owe uninterrupted availability of the platform; brief outages for maintenance or technical reasons give rise to no liability; Section 8.2 remains unaffected.
§ 9 Data Protection
Terra Mia Immobiliare processes personal data in accordance with the GDPR. To initiate a sale, Terra Mia Immobiliare may pass the Advertiser's contact details to Prospects to the extent necessary for making contact. Details are set out in the privacy policy at terra-mia.immo/privacy-policy.
§ 10 Changes to These Terms
(1) Terra Mia Immobiliare may amend these terms with effect for the future to the extent necessary to adapt them to changes in law, case law or official requirements, to regulate new services of the portal network that do not burden the Advertiser, to change the main parameters of the order of listings (Section 6.6), or to make purely linguistic changes. This does not apply to changes that shift the balance between performance and consideration to the Advertiser's disadvantage; paragraph 2 applies to those. The amendment is notified to the Advertiser by e-mail at least 30 days before it takes effect and is published. If the Advertiser does not object before the amendment takes effect, it is deemed accepted; Terra Mia Immobiliare points out this consequence separately in the notification. Until the amendment takes effect, the Advertiser may also terminate the contract without notice. If the Advertiser objects, the previous version continues to apply until the end of the current listing term. (2) All other amendments take effect only with the Advertiser's express consent in text form. Listings already paid for remain subject, until the end of their term, to the version in force when they were booked, unless an amendment under paragraph 1 has taken effect.
§ 11 Final Provisions
Severability
Should any provision be invalid, the validity of the remaining provisions is unaffected.
Governing Law and Jurisdiction
This listing contract between the Platform and the Advertiser is governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If the Advertiser is a consumer resident in the EU, the mandatory consumer-protection provisions and the statutory consumer place of jurisdiction of their state of residence remain unaffected. If the Advertiser is a merchant (Kaufmann) or has their registered office in another EU member state, the place of jurisdiction is Neuruppin, Germany. Rights and obligations arising from any purchase contract, and the law governing the property itself, are subject to the (Italian) law of the place where the property is located and are not the subject of these terms.
Language
These terms are provided in German, English and Italian. In case of doubt, the German version prevails.
